FINKE ONLINE SHOP REGULATIONS

 

Article 1

General provisions

 

1. The online shop [hereinafter referred to as ‘Shop’] carries out retail sales online through the Shop Owner, based on these Regulations [hereinafter referred to as ‘Regulations’].

2. The Shop Owner is:

3. Whenever the term Consumer appears in the document – it means a natural person carrying out a legal act not directly related to their business or professional activity.

4. The Regulations are an integral part of a sales contract concluded with a customer.

5. Conclusion of the sales contract is conditional upon acceptance of the Regulations by the customer in the course of placing an order by checking the appropriate box in the form.

6. Prices given in the Shop are gross (inclusive of VAT).

7. Goods available in the Shop are free of physical or legal defects.

 

Article 2

Orders

 

1. Orders can be placed as follows:

  • using the form available on the Shop’s website,

  • by email to the address available on the Shop’s website,

  • by phone to the numbers provided for placing orders, available on the Shop’s website in the ‘Contact’ tab,

  • via our social media: Instagram and Facebook.

 

2. In order to complete an order, the customer is obliged to provide data necessary to verify the customer and recipient of the good. The Shop confirms acceptance of the order by email or phone.

3. The parties are bound by the information given on the Shop’s website next to a good being purchased at the time of placing an order, in particular: price, good characteristics, features, components included in the ordered products, delivery date and method.

4. Information available on the Shop’s website is not considered a quotation within the meaning of the Civil Code. By placing an order a customer makes an offer to purchase a specific good. The sales contract is concluded when the Seller confirms that the Order has been accepted for fulfilment.

 

 

Article 3

Payments

1. A customer can choose from payment methods specified in the ‘Payment Methods’ tab.

2. Shipment prices: 

Domestic: PLN 18

International: PLN 70-100

 

3. Delivery of goods is conditional upon payment for the goods and shipment.

 

Article 4

Shipment of goods

1. The Shop sends the ordered goods through a courier service.

2. In case of payment by pay card, the order processing time is counted from the date of positive authorisation of the transaction.

3. For payments by bank transfer, the date of shipment extends by the period between the order placement and the date the Shop’s bank account is credited with any amounts due.

 

Article 5

Claims

1. In the event a good is not compliant with the contract the customer should send the claimed good back with a description of such non-compliance at the Shop’s expense.

2. The Shop responds to the customer’s claim within 14 days of receipt of the claim.

3. If satisfaction of a justified claim involves sending a new good to the customer or the removal of discrepancies, the cost of delivery shall be borne by the Shop.

4. The Seller stipulates that the difference in the pictures of goods resulting from individual settings of an individual customer’s computer (colour, proportions, etc.) cannot constitute the basis for a claim.

 

Article 6

Right of withdrawal from the contract

 

1. Pursuant to the Act of 2 March 2000 on Protection of Certain Consumer Rights and the Liability for Damage Caused by a Dangerous Product, a customer being a Consumer has the right to withdraw from a contract.

2. A customer has the right to withdraw from the contract without giving any reason within 14 days of conclusion thereof.

3. Custom-made products, size and colour tailored, differing from those offered in the regular sale are not returnable.

4. A customer being a Consumer may withdraw from the sales contract without giving any reason, making a statement in writing within 14 days of the date of delivery. In order to meet this deadline, it is sufficient to send the statement before the expiry thereof.

5. In the event of effective withdrawal from the sales contract, the contract shall be deemed not to have been concluded. The customer shall return the purchased good immediately, however, not later than within 14 (fourteen) days, and shall attach to the shipment the return form or data according to which the funds are to be returned.

6. Within 14 days of withdrawal from the contract by the customer the Shop Owner shall return the amount paid to the customer.

7. The customer shall not have the right to withdrawal in the cases described in the Act referred to in sec. 1 above.

Article 7

Privacy protection

 

1. The Shop Owner is the data controller.

2. Personal data provided to the Shop Owner is submitted voluntarily, provided, however, that failure to submit such data prevents placement and completion of a customer order.

3. The customer may also give separate consent to receive advertising and promotional materials from the Shop.

4. The customer has the right to access their personal data and rectify it, request it not be processed anymore and object to the processing thereof.

5. Personal data of the Buyer is processed under the contract and for the purpose of implementation thereof, according to the rules specified in the EU General Data Protection Regulation (GDPR). Specific information on data processing by the Seller is contained in the privacy policy available in the Shop.

 

Article 8

Intellectual property

 

1. No materials published on the Shop’s website (including pictures or descriptions of goods) can be used without the written consent of the Shop.

 

Article 9

Entry into force and amendments to the Regulations

 

1. These Regulations shall come into force on the day of its publication on the Shop’s website.

2. These Regulations may be amended and information on any amendments to the Regulations shall be sent to customers to the email address indicated in the order 14 days before the amended Regulations come into force.

3. In addition, amendments to the Regulations shall be published on the Shop’s website 14 days before the new Regulations come into force.

4. All orders accepted by the Shop Owner for fulfilment before the date of amendment to the Regulations shall be fulfilled in compliance with the regulations in force on the day the order was placed by the customer.

5. Should the customer not accept the new content of the Regulations, they shall notify the Shop Owner of this fact within 14 days of the date of being informed about the amendment to the Regulations.
